Eichleay Formula

When we have damage cases involving construction delays, we typically employ the Eichleay Formula in order to calculate those damages. Damages can be incurred if a construction company has a delay. Especially, if they cannot replace that job with another, thus resulting in overhead charges that cannot be charged to a Job. The Eichleay Formula is a court tested formulation that allows you to allocate overhead to a project and determine the actual damages that resulted from the delay.   Once the damages are established it is the attorney’s responsibility to prove that the reason for the delay was caused by the defendant.
